Recovery of Dues

Part 2
v     Application
The society has to make an application in the prescribed form to the concerned Deputy/Assistant Registrar, Co-operative Society of the ward for the issue of the recovery certificate, for the recovery of dues. The number of copies of such applications and other documents are as follows:

(1)    Copy to  --
(a)    One for Deputy Asstt. Registrar, Co-operative Society

(b)   One copy of all documents for members, joint/associate/nominal members

(2)    Enclosure to Application
True copy of –

(a)    The resolution passed by the managing committee

(b)   Extract of the ledger account of the member

(c)    Notices issued to the member for the payment of dues

(d)   A copy of the resolution passed by general body/managing committee where the society’s charges under various heads to be shared by members have been fixed in proportion.

(e)    True copy of the respective Bye-laws which provide for recovery of societies charges and interest under various heads from members.  The copies of these documents should be enclosed.

All the copies should be certified as true by The Chairman/Secretary.

v                                                          Fees And Other Expenses
The scale of fees and expenses fixed for deciding the cases u/s 101 of the Maharashtra Co-operative Societies Act, 1960.

      Rs.2001/- to 5000/-                                                                         @ 3.5%

      Rs. 16001/- to Rs.50000/-                                                                Rs.500/-

      Rs. 50001/- and above                                                                   Rs. 1000/-



The above amounts of fees are to be deposited in Reserve Bank of India by Challan under the head of account.
