Managing Committee

Part - 1



v     Definition
As per Section 2(7) of the Maharashtra Co-operative Societies Act, Committee means the Committee of management or board of directors or other directing body, by whatever name called, in which the management of the affairs of a society is vested under Section 73.

As per Bye-law No. 3(iv), the term “Committee” means the committee of management or other directing body to which management of the affairs of the society is entrusted.

v     Final authority in the society
As per Bye-law No.111 subject to the provisions of the Act, the Rules and the Bye-laws of the society, the final authority of the society shall vest in its general body meeting summoned in such manner as is specified in the Bye-laws.

v     The Management of The Affairs of The Society’s
As per Bye-law No.112 the management of the affairs of the society shall vest in the Committee duly constituted in accordance with the provisions of the Act, Rules and the Bye-laws of the society.

v     The basis for determining the strength of committee and the Quorum For Conducting The Meeting
As per Bye-law No.115 the strength of the committee and the quorum for conducting the Meeting is based on the number of members in the society i.e. as per the following chart.

The members of the managing committee of the society meet as often as required but at least once in a month to decide various important issues relating to the affairs of the society. The Chairman and Secretary in consultation with each other and under the guidance of the managing committee carry out the day to day work of the society. Other members of the society participate in its management through the general body meetings of the society.

(a)    One seat on the committee consisting of not more than 9 committee members;

(b)   Two seats on the committee consisting of 10 or more, but not exceeding 19 committee members; and

(c)    There seats on the committee consisting of 20 or more committee members.

As per sub-Section (2) of Section 73BBB the reserved seats referred seats referred to in sub-Section (1) shall be in addition to the strength of the members of the committee of the society. Provided that, where the Bye-laws of a society already provide for reservation of seats for women on the committee thereof, the total number of seats to be so reserved for women shall be equal to the number of seats specified in sub-Section (1) of Section 73BBB.

As per sub-Section (3) of Section 73BBB of the said Act, any individual woman member of the society, or any woman member of the committee of a member society, whether elected, co-opted or appointed, shall be eligible to contest the election to a reserved seat on a committee of the society and every person who is entitled to vote at the election of the committee shall be entitled to vote at the election to any such reserved seat. In the event of non availability of woman member for the managing committee, male members have to occupy the reserved seat to complete the total strength of the managing committee.
