v     Position In the case of inadequate valid nominations
Bye-law No.116 (b) states that in the event of receipt of inadequate valid nomination, required to constitute the full Committee, the General body at its meeting shall fill in the vacancies by election. On the failure of the general body meeting to elect the required number of members to constitute the Committee, the elected members of the committee shall be competent to fill in the same by co-option, whether they form the quorum or not.

v     Disqualifications For A Person For Election To The Committee
As per Bye-law No.118 no person shall be eligible for being elected as a member of the Committee or co-opted on it, if:

(1)   He has been convicted of an offence, involving moral turpitude, unless a period of six years has elapsed since his conviction,

(2)   He defaults the payment of dues to the society, within-three months from the date of service of notice in writing, served either by hand delivery or by post (under certificate of posting) demanding the payment of dues.

(3)   He has been held responsible under Section 79 or 88 of the Act or has been held responsible for the payment of the costs of enquiry under Section 85 of the Maharashtra Co-operative Societies Act, 1960.

(4)   He had without the previous permission of the society, in writing, sub-let his flat or part thereof or given it on leave and license or caretaker basis or has parted with its possession or in any other manner has sold his shares and interest in the society.

(5)   In case of an associate member, non submission of non-objection certificate and under taking as prescribed under these Bye-laws by the member.

v     Bond to be executed by elected Members of Managing committee
As per Section 711AB Rule No. 58-A. Every elected member of the Managing Committee shall executed member of the managing committee shall executed a bond on form M-20 within fifteen days of his assuming the office. The member who fails to execute such bond within the specified period shall be deem to have vacated his office as a member of the committee. The expenditure on stamp paper shall be born by the Society. The Secretary of the Society shall receive such bond and keep them on record of the society and accordingly inform the Registrar within fifteen days from formation of the committee.

v     Cessation of membership of the committee
Bye-law No.120 (1) – A person shall cease to be the member of Committee, if:

(1)   He has incurred any of the disqualifications mentioned under the Bye-law No. 118 enumerated above
(2)   He has failed to attend any three consecutive monthly meetings of the Committee, without leave of absence
